The Southeast Regional Service Commission oversees land management and planning activities and ensures municipal regulations agreed upon by Municipal Council are implemented.
Do you have a project?
Do you or your contractor want to build a house, carry out renovations, do landsccaping or excavating, put in new windows or take on other work? In many cases, you will need to obtain a building permit.
It is best to check with the commission and obtain your permit before ordering your materials or initiating any work. You do not want to end up with materials that can't be used or having to redo the work. The commission has the authority to put a stop to unapproved work, issue demolition orders and impose fines.
Permits and inspections
A permit is usually required in the following cases:
- construction work;
- conversion work;
- expansion work;
- building additions;
- use changes;
- transferring a building;
- relocating a building;
- demolition;
- filling or excavation work;
- modifying or installing an electrical system;
- building a patio;
- installing a sign;
- building a fence;
- installing a pool;
- etc.
This is not a complete list of all the work items needing a permit or certificate. Required documents depend on the nature and size of the project.
Rezoning
The Village de Memramcook uses a process called zoning to control land use within its territory.
Memramcook has a comprehensive zoning by-law (
Arrêté adoptant le Plan rural du Village de Memramcook et
zoning map) that divides the village into different land use zones. This by-law specifies the permitted uses (e.g. commercial or residential) as well as the requirements (e.g. building size and location) for each zone. In fact, zoning determines:
- how land may be used;
- where buildings and structures can be located;
- they types of buildings that are permitted and how they may be used;
- the lot sizes, parking requirements, building heights and setbacks from the street.
New developments and redevelopments must comply with the zoning by-law. The council may amend the by-law, and any person or developer may request an amendment to the by-law. If the change is minor, it is possible to allow a minor variance, otherwise the rezoning process may be initiated.
Subdivisions
The commission also receives and examines subdivision plans. A registered subdivision plan creates new separate parcels of land. It can be legally used for the sale of lots.
Subdivision approval ensures that the land is suitable for its proposed new use and that the proposal complies with the official plan as well as with provincial legislation and policies.
Taking into consideration factors such as topography, road access, water availability, sewage disposal, flood control and others, a subdivision plan application is reviewed for its level of suitability, and is checked against the official plan and zoning by-law. Conditions may also be attached to the approval such as road widening, naming of streets, parkland requirements and area rezoning to reflect the new subdivision use and any other municipal requirements.
In the cases where the subdivision includes extending or creating a new street, the developer must sign a subdivision agreement to ensure that certain services are provided after the plan has been registered. The developer must also comply with the following:

Policy regarding residential development incentives
Municipal Council has established a program to promote sustainable residential development within the Village de Memramcook. The two winning strategies are (1) residential development on existing lots and (2) the creation of new lots and residential developments contributing to the sustainability of the municipality. See

Other developments
Several other developments cannot be achieved without first obtaining a building permit or certificate of authorization.
Regardless of the nature or of the scope of your work or your activity, it is important to check with the commission before initiating the work in order to find out more about the current requirements and standards.
